Terms of Use for Partner Car Rental Companies

These Terms of Use (“Terms”) set forth the conditions under which Choice Signature Luxury Car Rental (“Choice Signature,” “we,” “our,” or “us”) engages with independent car rental companies (“Partner,” “you,” or “your”) that wish to receive vehicle leads, referrals, or introductions through our brokerage platform or related services.
By partnering with us, you agree to these Terms in full.
1. Scope of Services
Choice Signature acts solely as a broker and referral source by connecting vehicle owners seeking to exit their car loans with independent rental companies. We:

Do not take possession of vehicles.

Do not manage rental operations.

Do not guarantee the availability, quality, or suitability of any vehicle.

Do not guarantee the owner’s performance under any agreement.
2. Independent Contractor Relationship
You acknowledge that:

You operate as an independent business entity, not as an employee, agent, or representative of Choice Signature.

You are solely responsible for your own business operations, insurance, licenses, and compliance with applicable laws.
3. Partner Responsibilities
As a Partner, you agree to:

Conduct all transactions directly with the vehicle owner.

Assume responsibility for loan payments, insurance, maintenance, and any contractual obligations you agree to with the owner.

Maintain the vehicle in a safe, operable, and clean condition.
-
Avoid any fraudulent, misleading, or unlawful business practices.
4. No Guarantee of Leads or Volume
Choice Signature:

Makes no guarantee regarding the number, quality, or conversion of referrals.

Reserves the right to decline referrals to any Partner at our discretion.

May terminate the relationship at any time without cause.
5. Compliance with Laws
You must comply with all applicable federal, state, and local laws, including:

Motor vehicle regulations.

Consumer protection statutes.
-
Insurance and financial responsibility laws.

Privacy and data protection laws.
6. Liability & Indemnification
You agree to:

Assume full responsibility for all agreements, transactions, and vehicle-related matters with the owner.

Indemnify, defend, and hold harmless Choice Signature and its affiliates from any claims, damages, liabilities, or expenses arising from:

Your operations.
-
Your agreements with vehicle owners.

Your failure to comply with these Terms or applicable laws.

7. No Agency Relationship
Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship between Choice Signature and the Partner.
8. Termination
Either party may terminate the partnership at any time upon written notice. Termination will not relieve either party of obligations incurred before the termination date.
9. Confidentiality
You agree to:

Keep all non-public information about Choice Signature, vehicle owners, and referred leads confidential.

Use such information solely for the purpose of fulfilling your obligations under these Terms.
10. Limitation of Liability
Choice Signature is not responsible for:

Any disputes between you and a vehicle owner.

Non-payment, fraud, or misrepresentation by the owner.

Any operational or business losses you incur.
11. Governing Law
These Terms are governed by and construed under the laws of the State of Georgia, without regard to conflict of laws principles. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia.
